TOPIC

The information technology industry faces many of the same kinds of disputes as other industries (including the construction industry), but has been slower to adopt ADR. A likely consequence of the recent economic downturn is an increase in the number of disputes. Partnering, dispute boards and mediation have proven to be very effective in resolving disputes in the construction industry but these tools are seldom used in IT disputes. The panelists will discuss the dispute resolution challenges facing the IT industry and share best practices for avoiding and resolving disputes. The panel format will provide an opportunity for meeting attendees to share similar experiences and new perspectives.

Fraser Mann

He is past Co-Chair of the Technology and E-commerce Law Committee of the International Bar Association, and past Chairman of the International Law Section of the Canadian Bar Association. He is Past-President of the Intellectual Property Institute of Canada. Michael is a director of the ADR Institute of Ontario and co-chaired the ADRIO Technology and Intellectual Property Section. He is a member of the ADR Institute of Canada. He was a founding member of the Information Technology and E-Commerce Section of the Ontario Bar Association.

Michael Lindsay
Lindsay Associates

Michael Lindsay, P.Eng., MBA, is the principal of Lindsay Associates and co-chair of the ADR Institute of Ontario Construction section. He regularly mediates construction and condominium disputes and has managed large scale information technology projects as well as complex construction and engineering projects.

Cost for lunch: ten dollars ($10) for members and students, twenty dollars ($20) for non-members, payable at the meeting. Receipts will be available. Cheques should be made payable to the Toronto Computer Lawyers’ Group.
